Welcome to AppScout. These Terms of Service ("Terms") govern your use of the AppScout
mobile application ("App", "Service", "we", "us", or "our"). By downloading, installing,
or using AppScout, you agree to be bound by these Terms.
Important: Please read these Terms carefully. If you do not agree with any part of these Terms, you should not use AppScout.
1. Acceptance of Terms
By accessing or using AppScout, you agree to:
- Be bound by these Terms of Service
- Comply with all applicable laws and regulations
- Accept our Privacy Policy
- Be at least 13 years of age (or the minimum age required in your jurisdiction)
2. Description of Service
AppScout is a mobile application that helps indie developers and studios discover, analyze, and monitor mobile app opportunities across the App Store and Google Play. Features include:
- App discovery through curated lenses and search
- Revenue, download, and rating data for apps
- AI-powered opportunity analysis and SWOT assessments
- App monitoring with real-time alerts
- Opportunity briefs and saved lists
- Custom lens creation
3. License and Usage Rights
3.1 License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install AppScout on your personal device
- Use the App for your personal or business purposes
- Access features and data within the limits of your subscription tier
3.2 License Restrictions
You agree NOT to:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels
- Rent, lease, lend, sell, redistribute, or sublicense the App
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any part of the App or its systems
4. User Accounts
4.1 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
- Keeping your device and operating system up to date
4.2 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the service.
5. Subscriptions and Billing
AppScout offers free and paid subscription tiers. Paid subscriptions are billed through the App Store (Apple) or Google Play and are subject to their respective billing policies.
- Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
- Refunds are handled by Apple or Google according to their respective policies
- Downgrading your plan takes effect at the end of the current billing period
- Free tier features are subject to daily usage limits
6. Acceptable Use
You agree not to:
- Use AppScout for any unlawful purpose
- Attempt to scrape, extract, or systematically download data from AppScout
- Interfere with or disrupt the service, servers, or infrastructure
- Share, sell, or transfer your account to another person
- Use automated tools, bots, or scripts to access the service
- Circumvent usage limits, quotas, or rate limiting mechanisms
- Use data obtained through AppScout to infringe on intellectual property rights
7. App Market Data
AppScout displays app market data including revenue estimates, download figures, and rankings:
- Accuracy: All figures are estimates and approximations. They should not be relied upon as exact values
- Usage: Data is provided for informational and research purposes only
- No guarantees: We do not guarantee the accuracy, completeness, or timeliness of any market data displayed in the App
8. AI-Generated Content
AppScout uses AI to generate opportunity analysis, SWOT assessments, and build/skip verdicts:
- AI-generated content is provided as guidance only and should not be taken as professional business advice
- You are solely responsible for any business decisions made based on AI-generated insights
- We do not guarantee the accuracy or reliability of AI-generated content
- AI analysis may not reflect all market conditions
9. Intellectual Property
All rights, title, and interest in and to AppScout, including all intellectual property rights, are owned by HorizonSoft. This includes:
- The App's source code, design, and functionality
- All graphics, logos, and visual elements
- Scoring algorithms and lens configurations
- Documentation and user interface design
Your saved data (bookmarks, custom lenses, monitoring configurations) remains your property. We claim no ownership rights over your user-generated content.
10. Privacy and Data
Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy. Key points:
- Your data is stored securely on cloud infrastructure
- We do not sell or share your personal data with third parties
- We do not display advertisements
- You can delete your account and data at any time
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPSCOUT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- That the App will be uninterrupted, error-free, or secure
- That app market data or AI analysis will be accurate or complete
- That defects will be corrected in any particular timeframe
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HORIZONSOFT SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Any damages resulting from your use or inability to use the App
- Business decisions made based on data or AI analysis provided by the App
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.
13. Third-Party Services
AppScout integrates with third-party services for authentication, data storage, analytics, subscriptions, and notifications. We are not responsible for:
- The content or practices of third-party services
- Any transactions or interactions with third parties
- Third-party privacy policies or terms of service
- The availability or performance of third-party services
14. Indemnification
You agree to indemnify and hold harmless HorizonSoft and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Business decisions made using data or analysis from the App
15. Updates and Modifications
15.1 App Updates
We may:
- Release updates, patches, and new versions of the App
- Modify, add, or discontinue features at any time
- Change lens configurations, scoring algorithms, or data sources
- Require you to update the App to continue using it
15.2 Terms Updates
We reserve the right to modify these Terms at any time. We will notify you of significant changes through:
- In-app notifications
- Email (if provided)
- Updates to this page
Your continued use of the App after changes constitutes acceptance of the updated Terms.
16. Termination
16.1 By You
You may stop using the App at any time by:
- Uninstalling it from your device
- Deleting your account from Settings within the app
When you delete your account, all your data is permanently removed.
16.2 By Us
We may terminate or suspend your access if you:
- Violate these Terms
- Abuse the service or circumvent usage limits
- Engage in fraudulent or illegal activities
17. Geographic Restrictions
AppScout is intended for worldwide use. You are responsible for ensuring that your use of the App complies with local laws and regulations in your jurisdiction.
18. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
19. Dispute Resolution
In the event of any dispute arising from these Terms or your use of the App, you agree to:
- First attempt to resolve the dispute informally by contacting us
- Pursue binding arbitration if informal resolution fails
- Waive the right to participate in class action lawsuits
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HorizonSoft regarding AppScout.
